How to draft Witness Statement for witnesses outside Australia

If some of your witnesses are non Australian citizens or not a Permanent resident of Australia, it is a good idea to do the statement in the format using the template provided below. 

There are a number of things a witness must provide in order to prove that the applicant and sponsor's relationship is genuine.

One of the most frequently asked questions we receive about overseas witness statements for non-Australian/non-permanent residents is, should they have their statement notarised or witnessed. There is no ‘hard and fast’ rule about this. The reason a Statutory Declaration or Form 888 is preferred for Australian witnesses for example is because providing a statement in this format is a very strong form of promise, lying in a statement of this nature can be a criminal offence. So essentially these statements could be argued to carry more weight as there is incentive for witnesses to be honest. If there are weaknesses in your application as identified by our team in your review, then we may recommend you have overseas witnesses go to the effort of having statements notarised/certified or witnessed to see them carry more weight in terms of legitimacy.
